This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the domain name https://matuamatrimony.com ("Website"), including the related mobile site and mobile application (hereinafter referred to as "Platform").

The Platform is owned and operated by Matua Matrimony, with its registered office at Chikanpara, Thakurnagar, North 24 Parganas, West Bengal, India (hereinafter referred to as "Platform Owner", "we", "us", "our").

Your use of the Platform and services and tools are governed by the following Terms of Use ("Terms") as applicable to the Platform, including the applicable policies which are incorporated herein by way of reference. If you transact on the Platform, you shall be subject to the policies applicable to the Platform for such transaction. By mere use of the Platform, you shall be contracting with the Platform Owner and these Terms and conditions, including policies, constitute your binding obligations with the Platform Owner.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS CAREFULLY BEFORE PROCEEDING.

These Terms can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms to stay informed of updates.

1. Acceptance of Terms

By registering on, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Platform.

For the purpose of these Terms, wherever the context so requires, "you", "your" or "user" shall mean any natural or legal person who has agreed to become a user/buyer on the Platform.

2. Eligibility

To register on the Platform, you must:

  • Be at least 18 years of age (21 for males, in compliance with The Prohibition of Child Marriage Act, 2006).
  • Be legally eligible to marry under the laws applicable to you.
  • Be a resident of India or a Person of Indian Origin (PIO).
  • Provide accurate, complete, and truthful information to us during and after registration. You shall be responsible for all acts done through the use of your registered account on the Platform.
  • Not be currently registered under a different account.

3. Account Registration and Security

  • You are responsible for maintaining the confidentiality of your login credentials (mobile number, OTP, password).
  • You must not share your account with any other person.
  • Notify us immediately at support@matuamatrimony.com if you suspect unauthorised access.
  • We are not liable for loss or damage arising from your failure to keep your credentials secure.
  • You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with the Platform Owner for the Services.

4. Profile Creation and Content

  • All information provided on your profile must be accurate and truthful.
  • Profiles may be created by an authorised agent on behalf of a family member, provided the member's explicit consent is obtained via the Platform's consent and verification process.
  • You may not include contact information (phone, email, WhatsApp) in your profile bio, photos, or any visible field.
  • Profile photos must be recent (within 2 years), clearly show your face, and must not include other individuals.
  • We reserve the right to reject, edit, or remove any profile content that violates these Terms.
  • The contents of the Platform and the Services are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents include and are not limited to the design, layout, look, and graphics.

5. Prohibited Conduct

You must not:

  • Create false, misleading, or impersonating profiles.
  • Harass, threaten, abuse, or intimidate other members or staff.
  • Upload obscene, pornographic, defamatory, or unlawful content.
  • Use the Platform for commercial solicitation, advertising, or recruitment.
  • Collect or misuse contact information of other members.
  • Attempt to gain unauthorised access to other accounts or our systems.
  • Use bots, scrapers, or automated tools to access the Platform.
  • Use the Platform and/or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or Indian or local laws that might apply to you.
  • Violate any applicable Indian law including the Indian Penal Code, IT Act 2000, or POCSO Act.
  • You acknowledge that unauthorised use of the Platform and/or the Services may lead to action against you as per these Terms and/or applicable laws.

6. Verification and Identity

We require Aadhaar-based phone OTP verification and video verification for account activation. Providing false documents for verification constitutes fraud and will result in immediate account suspension and may be reported to law enforcement.

7. Subscriptions and Payments

  • Subscription fees are clearly displayed before purchase and are billed in advance. You agree to pay us the charges associated with availing the Services.
  • Payments are processed through secure, PCI-DSS-compliant payment gateways including Razorpay, PhonePe, and Stripe.
  • Subscription renewals (if opted in) will be charged automatically. You may cancel auto-renewal at any time.
  • Pricing is subject to change with 7 days' prior notice.
  • All prices are inclusive of applicable GST unless stated otherwise.

8. Intellectual Property

You retain ownership of content you upload. By uploading content, you grant Matua Matrimony a non-exclusive, royalty-free, worldwide licence to display, reproduce, and use your content solely for the purpose of providing the Platform's matrimony services. This licence terminates upon account deletion.

All other content on the Platform — including the name "Matua Matrimony", logos, design elements, and software — are the exclusive property of the Company and may not be copied or used without written permission.

9. Third-Party Links and Websites

You agree and acknowledge that the Platform and the Services may contain links to other third-party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of such third-party websites. These links are provided for your convenience to provide further information. We are not responsible for the content or practices of any third-party sites.

10. Disclaimer of Warranties

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this website or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of our Services and the Platform is solely and entirely at your own risk and discretion for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements.

  • Matua Matrimony is a matrimony facilitation platform. We do not guarantee that you will find a suitable match.
  • We are not responsible for the conduct, behaviour, or representations of individual users.
  • We do not conduct police verification of members. We strongly advise meeting in public places and conducting your own due diligence before proceeding with a match.
  • The Platform is provided "as is" without warranties of any kind, express or implied.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

12. Termination

  • We may suspend or permanently terminate your account for violation of these Terms, without prior notice and without liability.
  • You may delete your account at any time from your Account Settings. Upon deletion, your profile will be immediately removed from public view.
  • Termination does not entitle you to a refund except as provided in our Refund Policy.

13. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Matua Matrimony shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform. Our total aggregate liability shall not exceed the subscription fee paid by you in the 3 months preceding the event giving rise to the claim.

14. Indemnification

You shall indemnify and hold harmless the Platform Owner, its affiliates, group companies (as applicable) and their respective officers, directors, agents, and employees from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms, Privacy Policy and other Policies, or your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

15. Force Majeure

Notwithstanding anything contained in these Terms, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event, including but not limited to acts of God, natural disasters, war, civil unrest, government actions, pandemic, or failure of internet infrastructure beyond the party's reasonable control.

16. Governing Law and Dispute Resolution

These Terms and any dispute or claim relating to them, or their enforceability, shall be governed by and construed in accordance with the laws of India.

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in North 24 Parganas, West Bengal, India.

Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved within 30 days, the matter shall be referred to the competent courts as stated above.
